Customs representation is being re-institutionalized, the concept of “customs broker” is being replaced with “indirect customs representation,” and in addition, a registry will be created, direct customs representation will be introduced, and the licensing requirement for this field will be abolished, APA reports.

This is reflected in the amendment proposed to the Customs Code discussed at today’s session of the Milli Majlis.

According to the draft, the concept of “customs broker” is replaced with “indirect customs representation.” While customs broker activity was carried out on the basis of a license, inclusion in the relevant registry is required to become an “indirect customs representative.” The placement of the “indirect customs representative” registry on the website of the customs authority will increase the ability of foreign trade participants to use this professional service and will serve the formation of services and a competitive environment in this field. Indirect customs representation related to the import of goods and vehicles into the customs territory, their export from this territory, or their transit will be carried out by legal entities. When customs control and customs clearance are carried out, the indirect customs representative will fulfill all the duties of the person independently moving the goods across the customs border and will bear responsibility like that person. During customs control and customs clearance, the customs declaration and other customs documents will be submitted electronically to the customs authority by the legal entity carrying out indirect customs representation as the declarant.

According to the draft, direct customs representation will be carried out on the basis of a power of attorney given by the represented person through individuals, which will create additional opportunities for foreign trade participants. Currently, legal entities that have obtained a license to carry out customs carrier activities can be customs carriers. The proposed amendment includes simplifying the requirement for this carrier, expanding the circle of persons who can be carriers, and abolishing the license. Thus, carriers may be legal entities and individuals engaged in entrepreneurial activity who carry out the transportation of goods and vehicles under customs control, and the activity of the relevant authority will consist of publishing lists of these carriers, placing them on the official website, and ensuring the continuous updating of information. The publication of the list of carriers and its placement on the official website of the customs authority will make carriers accessible to foreign trade participants, and at the same time, records and an electronic history of persons providing this service will be formed.

A customs fee in the amount determined by the relevant executive authority will be charged for issuing a qualification certificate to specialists in customs clearance.

After discussions, the draft law was put to a vote and adopted in the first reading.
