Azerbaijan sets procedure to restrict departure of foreign trade participants with customs debt from country

The procedure for restricting the departure of foreign trade participants with customs debts from Azerbaijan is being determined, APA reports.

This is reflected in a proposed amendment to the Customs Code discussed at today’s session of the Milli Majlis.

According to the draft, it is proposed to add to the rights of customs authorities the ability to apply to a court to temporarily restrict a foreign trade participant’s right to leave the country, in order to ensure the payment of calculated customs payments, penalties, and interest on customs debt, if the foreign trade participant fails to fulfill the obligation to pay the customs debt within the period established by this Code. It is also proposed to include among the duties of customs authorities the adoption of an immediate decision to lift the restriction once it is determined that the grounds that led to the temporary restriction on the foreign trade participant’s right to leave the country have been eliminated.

Thus, the temporary restriction on the right to leave the country will be enforced by a court upon the application of the customs authority.

Similar powers are defined for tax authorities in the Tax Code.

Following discussions, the draft law was put to a vote and adopted in the first reading.
