Azerbaijani General Prosecutorâ€™s Office: â€œ25 people were questioned during the investigation of Guba incidentâ€

Baku. Hafiz Heydarov â€“ APA. The General Prosecutorâ€™s Office and Interior Ministry issued joint statement on Guba incident, APA reports. The website of the General Prosecutorâ€™s Office says that the press has recently released reports distorting real essence of the incident occurred in Guba city on March 1, 2012, including incorrect reports on mass arrests by the law-enforcement bodies. Thatâ€™s why the General Prosecutorâ€™s Office and the Interior Ministry consider it necessary to report following details to respond the citizensâ€™ addresses to the law-enforcement bodes.

About 1000 Guba residents, who considered the words of the chief of Guba regional executive power Rauf Habibov at the meeting dedicated to the discussion of social problems, which was held on November 22, 2011 as disrespect to the Guba residents, held a protest action outside the administrative building of the executive power on March 1, 2012. At first the rally wasnâ€™t directed to the violation of order and had a character of support of statehood. Then the rally passed to the violation of public order, destruction of private and state property, use of violence. The windows of the first and second floors of the Executive Powerâ€™s building and the equipments there were broken, several constructions, including Habibovâ€™s private house were burnt, 24 police officers were injured.

The criminal case was launched that day by Guba regional prosecutorâ€™s office on Criminal Codeâ€™s â„–233 (Organization of actions promoting infringement of a social order or active participation in such actions) and â„–186 (Deliberate destruction or damage of property) and send to the General Prosecutorâ€™s Officeâ€™s Investigation Office on Serious Crimes.

25 persons were questioned during the investigation of the incident. 7 of them, including Farhad Abdulrahmanov, Alkhas Danyalov, Sakhavat Vaizi, Samir Khanmedov, Khayyam Yunusov, Zamistan Amiraslanov and Safar Garibov, who actively participated in the violation of public order and destruction of property belonging to legal and physical bodies, were charged of the above-mentioned articles of Criminal Code and arrested.

The investigation of the reasons of the incident showed that chairman of Guba city municipality and the council of regional municipalities Elkhan Aliyev asked Vugar Gonagov, executive director of Khayal TV, which taped the meeting held on November 22, 2011, to prepare short version of the Habibovâ€™s speech at that meeting, and paid AZN 140 to him.

The TV stationâ€™s editor-in-chief Zaur Guliyev and picture editor Islam Aslanov by the instruction given by Vugar Gonagov made an item breaking of the successions of the parts of the speech about the illegal actions of some residents and connecting separate words. The tape was given to Vugar Gonagov on December 18, 2012 and he gave it to Elkhan Aliyev.

Besides, advisor of State Property Issues Committeeâ€™s Guba territorial department â„–13 Zakir Mammadov gave the videotape of the speech of the head of executive power, as well as the video of the list and pictures of the property owned by Rauf Habibov and his relatives to Rovshan Maharramov, salesman of local â€œEnigmaâ€ store, and asked to spread it on internet. Rovshan Maharramov placed the video tape on â€œodnoklassniki.ruâ€ and â€œmail.ruâ€ websites on February 20, 2012. Salesman of the grocery store of the region Ali Zeynalov, who got these videos, gave these to Imran Mustafayev who is the leaseholder of the â€œMMMâ€ internet club in Guba city. On February 21, Imran Mustafayev posted video on youtube.com using login and password which belong to disabled Mustafa Nurullayev.

The flyers of destructive content, 3 CDs, processor and other evidences belonging to Khayal TV were taken as a material proof as a result of search of Zakir Mammadovâ€™s apartment.

Zakir Mammadov, Elkhan Aliyev, Zaur Guliyev and Vugar Gonagov were accused of Criminal Codeâ€™s articles â„–233 (Organization of actions promoting infringement of a social order or active participation in such actions) and â„–309 (Excess of official powers) and sent to pretrial detention.

The investigation and operational search actions on the criminal case are being continued.
