The next court hearing was held regarding the special prosecution complaint against Isfandiyar Akhundov (Sharurlu Isfandiyar), the owner of “Sharur MTK,” APA reports.
Today, at the Binagadi District Court, presided over by Judge Vusal Taghiyev, Emil Samandarov’s lawyer, Asim Abbasov, read out a motion submitted to the court electronically.
The lawyer stated that although the expert opinion mentioned the word “embezzlement,” and it is reflected as a criminal subject in the relevant articles of the Criminal Code, it was treated as a critical point in the case. The submitted opinion did not touch upon the word “fraud,” and no investigation was conducted. Although certain amounts are mentioned in the video, nothing has been written about them.
The lawyer also added that the director of the Institute of Linguistics of the Azerbaijan National Academy of Sciences (ANAS) was appointed during the tenure of Ramiz Mehdiyev, who is currently accused of treason. Additionally, some media outlets have published articles suggesting a connection between Ramiz Mehdiyev and Isfandiyar Akhundov. This indicates that the expert opinion is biased. He requested that the opinion be removed from the list of evidence.
Defense lawyer Ulvi Nasibli stated that the issue of linking Isfandiyar Akhundov to Ramiz Mehdiyev should be approached with humor.
Lawyer Shahbaz Karimli told the court that evidence must be reliable. There has been no connection between Ramiz Mehdiyev and Isfandiyar Akhundov.
The accused, Isfandiyar Akhundov, emphasized that he has no connection with Ramiz Mehdiyev: “As for Ramiz Mehdiyev, the State Security Service (SSS) is dealing with this matter. The necessary persons will be lawfully punished. We do not know more than them.”
Lawyer Asim Abbasov stated that the articles published in the media are not new; they were published in 2020, at which time Ramiz Mehdiyev held office.
The lawyer added that during the court investigation, both the accused and his child went for discussions with them, and calls were made regarding an agreement: “There are also records regarding this. Our demand is the acknowledgment of the mistake you made.”
The court left the motion to remove the opinion from the list of evidence unconsidered and stated that the motion would be evaluated when the final court decision is issued.
Additionally, the court addressed the previous motion submitted by lawyer Asim Abbasov regarding the questioning of the expert who gave the opinion, which had also been left unconsidered.
The court did not grant the mentioned motion.
Subsequently, the documents were examined.
After the examination of the documents, the court announced the conclusion of the investigation.
The lawyer of Emil Samandarov, who filed the complaint under the special prosecution procedure, requested time to speak.
The next court hearing was scheduled for December 22.
Note that a special indictment has been filed against Isfandiyar Akhundov under Articles 147.2 (defamation) and 148 (insult) of the Criminal Code. The special indictment was filed by Emil Samandarov, the head of “Progress 2016” MTK. According to the accusation, Isfandiyar Akhundov presented Emil Samandarov as a fraud in one of his interviews.
