European Court of Human Rights passes next judgment on Azerbaijan

Baku. Viktoriya Dementyeva - APA. On November 25, the European Court of Human Rights passed next judgment concerning Azerbaijan, APA reports. Relying on Article 6 § 1 (right to a fair hearing) and Article 1 of Protocol No. 1 (protection of property) to the European Convention on Human Rights, they complained of the non-enforcement of a final judgment ordering the restoration of Faber Firm’s right of use over a plot of land. Court’s decision considers enforcement of the judgment of 12 October 2005 within three months, payment of 4,800 euros (EUR) (non-pecuniary damage) to the applicants jointly and EUR 1,500 (costs and expenses) compensation. Remind that, Azerbaijani citizen Sabir Jafarov, born in 1958, filed an appeal against non-fulfillment of the court’s decision about restoration of his rights on use of lot owned by “Faber” company, which he chaired. Moreover he noted that just judicial law and articles on protection of property of the European Court of Human Rights had been disturbed.
