Azerbaijan to increase liability for military personnel, introduce alternative penalties

Liability for officers, warrant officers, midshipmen, and military personnel serving beyond the compulsory term of active military service will be increased, and an alternative punishment will be introduced, APA reports.

This is reflected in a proposed amendment to the Code of Administrative Offenses submitted for discussion at today's meeting of the Legal Policy and State Building Committee of the Milli Majlis.

The draft law stipulates that the absence of these individuals from their military unit or place of service for more than one day will result in administrative liability.

Thus, if an officer, warrant officer, midshipman, or military serviceman serving beyond the compulsory term of active military service leaves a military unit or place of service without authorization, or fails to arrive at the military unit or place of service on time without valid reasons, for a period exceeding one day but not more than ten days, a fine ranging from 200 to 300 manats will be imposed, or administrative detention for up to 15 days may be applied, taking into account the circumstances of the case and the personality of the offender.

Under the current Code, administrative detention for up to 20 days is imposed for the same offense.

If the same acts are committed repeatedly by a person who has already received an administrative penalty within one year from the date the decision imposing that penalty enters into force, a fine ranging from 300 to 500 manats will be imposed, or administrative detention for a period of 10 days to one month may be applied, taking into account the circumstances of the case and the personality of the offender.

Under the current Code, administrative detention for a period of 15 days to one month is imposed for the same administrative offense.

It was noted that, alongside increasing liability, easing the sanctions and introducing an alternative form of punishment (a fine) could be considered a progressive step.
