At today’s session of the Milli Majlis, a new draft law “On the Rights of the Child” was put up for discussion, APA reports.
The draft law consists of 8 chapters and 63 articles.
Under the draft, a database on the implementation of children’s rights will be established
The upbringing of children in the spirit of patriotism is included among the objectives of state policy. The main guarantees of the priority of children’s interests are determined, and the rights to liberty and personal inviolability are expanded. Except for cases specified by law, a child may not be monitored, subjected to video and photo recording, audio recording, or other such actions. Except in cases specified by law, the state guarantees the right of children to maintain the confidentiality of information transmitted by correspondence, telephone conversations, mail, telegraph, and other means of communication. The scope of children’s personal data, as well as the conditions for their collection, processing, transmission, use, and protection, are determined by law.
Under the draft, parents (or persons acting in their place) may, by mutual consent, raise their children in accordance with their own religious beliefs and attitude toward religion.
To protect children from violence, new obligations are also established for educational and medical institutions. Parents (or persons acting in their place), as well as employees of educational, medical, social service, sports, cultural, recreation, and penitentiary institutions responsible for supervising children, must, while observing confidentiality, report signs of violence against a child to the relevant law enforcement authorities or to the local commission for the protection of children’s rights in the respective area, and may also report the case to the child hotline service. Parents (or persons acting in their place), as well as officials of state bodies (institutions), medical institutions, law enforcement authorities, and other competent bodies, are obliged to take all necessary measures to restore the physical health and psychological condition of a child who has been subjected to violence.
A child has the right to receive financial support in an amount not less than the subsistence minimum established by law
Under the draft, children will be provided with free psychological assistance in educational institutions.
A requirement is introduced for a psychologist to participate during investigative actions.
The draft law was put to a vote and adopted in the third reading.
