The obligation of employers to ensure equal pay is being specified in order to guarantee gender equality, APA reports.
This is reflected in the amendments to the Labor Code approved by President Ilham Aliyev.
Under the draft, employers are required to pay equal wages to employees performing the same or different work of equal value, regardless of gender. The determination of work of equal value must be made by the employer, taking into account working conditions, the nature of the labor function, and the tariff-qualification characteristics set out in the unified tariff-qualification reference books currently in force.
Accordingly, under the amendment to the law ‘On Guarantees of Gender (Men and Women) Equality,’ Article 9.1 has been revised. Thus, employers must provide equal pay to employees performing the same or different work of equal value, regardless of gender. The equal value of work will be determined by the employer in accordance with the requirements of the Labor Code, taking into account working conditions, the nature of the labor function, and tariff-qualification characteristics provided for in the current unified tariff-qualification reference books.”
