Azerbaijan sets new penalties for terrorism-related activities

Creating a terrorist organization or leading such an organization or its structural units will be punishable by 10 to 14 years of imprisonment, APA reports.

This is reflected in the new Article 214-4 added to the Criminal Code approved by President Ilham Aliyev.

Membership in a terrorist organization or participation in its activities will be punishable by imprisonment for a term of 7 to 12 years. The note to the article stipulates that a person who is a member of a terrorist organization or participates in its activities shall be exempt from criminal liability if they timely inform the authorities or otherwise assist in preventing criminal acts and in identifying persons who created, led, participated in, or financed the terrorist organization, provided that their actions do not constitute another crime.

In addition, technical amendments are envisaged in the articles of the Criminal Code on financing terrorism (214-1) and public calls for terrorism (214-2), as well as in Article 1 of the Law “On Combating Terrorism.”

Article 282 of the Criminal Code is also being revised. Thus, Article 282.1 adds new targets such as weakening scientific and technical potential, as well as disrupting the normal functioning of critical information infrastructure, energy, transport, and telecommunications networks. Cases involving the use of artificial intelligence technologies and special software in committing sabotage are also included among the methods of committing sabotage.

According to the code, Article 282.2 introduces a number of new aggravating circumstances. These include sabotage committed by a criminal organization, during a state of emergency or martial law, during a special regime of social emergency or mass unrest, through abuse of official position, or resulting in death or other grave consequences by negligence.

According to the note to Article 282, a person involved in preparing sabotage shall be exempt from criminal liability if they timely inform the authorities or otherwise assist in preventing such an act, provided that their actions do not constitute another crime.
