â€œCustodial restraintâ€ penalty cancelled in Azerbaijan

APA reports that the draft amendments have been discussed and adopted at todayâ€™s meeting of parliament.

According to the amendments to both codes, the â€œcustodial restraintâ€ penalty has been excluded from the system of penalties. The relevant clauses have been excluded from the documents or replaced with another kind of penalty. An intermediate clause has been added to the Code of Execution of Judgments.

According to the intermediate clause, after the amendments and annexes come into force, the judgments concerning the persons, who underwent custodial restraint, will be reconsidered. The courts will reconsider the penalty basing on the application of the prisoners or the introduction of the institution that executed the penalty. Until the law comes into force, if unserved term of the punishment is not more than a year, the custodial restraint will be replaced with corrective labor or AZN 300-500 fine, if unserved term of punishment is up to two years the custodial restraint will be replaced with corrective labor or AZN 500-800 fine.

If unserved term of punishment is more than two years the custodial restraint will be replaced with corrective labor or AZN 800-1000 fine.
