-Beforehand, auctions on sale of land were holding, press is also being invited to these auctions. Why is the press not invited to these auctions now? Are not auctions held?
-As provided in the article #9 of the Law ‘On municipality lands management’, the municipalities preferred to lease, giving to private property and usage their lands directly, while they had to carry out these operations through auctions and contests. This causes creation of negative cases.
In order to ensure transparency in allocation of plots of land, the order of Azerbaijani President on “”application of 466-IIIQD law, dated to October 23, 2007, of Azerbaijan” on amendments and annexes to some legislative acts of Azerbaijan Republic” in connection with lease and giving of municipal lands to private property through only contests and auctions has legalized obtaining of the rights on private property, lease and usage through only auctions and contests. Thus, this law put an end to illegal sale of plots of land by municipalities. As an organizer, the Committee has been commissioned with holding of auctions and contests. The commission established for ensuring transparency consists of 2 employees of the Committee and 3 members of public.
The rights on private property, lease and usage of are given through auctions and contests for seven years. Related information is published in “Torpaq” (land) newspaper and posted on the website of the Committee. Auctions and contests are open for press representatives.
Individual houses have been built on the lands suitable for agriculture in the country. What about them?
- Recently, it was revealed from the researches and monitoring carried out by the experts as well as the reports submitted to the Committee, some individuals, legal and natural persons build individual residential houses, commercial facilities and recreation areas, illegally occupying the lands (illegally changing the designation of the lands) which are suitable for agriculture and given to citizens as a result of land reforms and the agricultural lands of the reserve fund of the municipalities.
As the penalties are less for implementation of administrative disciplinary actions in order to prevent the cases of violations of the law of land provided by the Administrative Offences Code of Azerbaijan Republic, such cases are difficult to be prevented. The experts of the Committee revealed 422 violations of the law in the country in 2013 and 150 cases were applied fines in the amount of 15,372 AZN.
Therefore, it considered appropriate to tighten existing legislation and develop a new draft law in order to prevent illegal use of agricultural lands.
For this purpose, the Committee has developed draft laws to increase the penalties in the Land Code, Code of Administrative Offences and Criminal Code in connection with willfully occupying of agricultural lands, change of designation, reduction of fertility and these draft laws have been submitted to the Cabinet of Ministers agreeing with the relevant executive bodies.
We think that these sanctions will help prevent these acts directed to violation of rights over the land to be regulated by relevant laws, especially worsening of quality of agricultural lands, as well as removal from usage.
-Is purchase of unmanned aerial vehicles for cartographical works on the agenda?
-The cartographic photos have been taken from sounding satellites of the Earth. Modern technologies are so that local photos are taken via small unmanned vehicles. Thereafter, special software changes it to the necessary format and it’s possible to work on it and compile all types of e-maps. Acquisition and usage of these vehicles are on the agenda. A number of test flights have been carried out.
