Children have the right to express their opinion on matters related to their case during proceedings in accordance with the procedure established by law, APA reports.
This is reflected in the new draft Law “On the Rights of the Child” discussed at today’s meeting of the Milli Majlis Committee on Family, Women and Children’s Affairs.
The process of obtaining a child’s opinion must be informative, based on respect for the child, safe, and guided by a specialist trained in the field of child-related matters.
In this regard, amendments to civil and criminal procedural legislation are also being proposed. Under the proposed changes to the Civil Procedure Code and the Criminal Procedure Code, a requirement is being introduced for a psychologist to participate, along with other persons, when a child’s opinion is being obtained in civil cases, and during investigative actions in criminal cases, including the questioning of a minor witness or victim, confrontations, on-site verification of statements, investigative experiments, and the collection of samples for examination.
