The maximum service age for each rank will be determined as the retirement age for that rank, APA reports.
This is reflected in a proposed amendment to the Law “On Labor Pensions” submitted for discussion at today’s meeting of the Milli Majlis.
Under the current law, the following military personnel (excluding military personnel deprived of military ranks and military personnel undergoing compulsory active military service) are entitled to an old-age labor pension as military personnel from the date of discharge from military service:
- military personnel who have served in the military for 25 calendar years or more before being discharged from military service;
- persons discharged from military service due to age who, on the date of discharge, have 30 calendar years or more of total work experience, at least 15 years of which were spent in military service;
- persons discharged from military service due to illness or limited health capabilities, as well as due to staff reductions, who are aged 48 or older on the date of discharge and have 30 calendar years or more of total work experience, at least 15 years of which were spent in military service;
- military personnel with 15 years or more of military service who participated in work to eliminate the consequences of the accident at the Chernobyl Nuclear Power Plant in the resettlement zone.
Under the draft, the following military personnel discharged from military service (excluding military personnel deprived of military ranks and military personnel undergoing compulsory active military service) will be entitled to an old-age labor pension as military personnel from the date they reach the maximum age for service in peacetime established by law for their last rank:
- military personnel who have served in the military for 25 calendar years or more before being discharged from military service (20 calendar years for military personnel who had served at least 17 calendar years as of January 1, 2024 and were discharged before completing 25 calendar years of military service);
- persons who, on the date of discharge from military service, have 30 calendar years or more of total work experience, at least 15 years of which were spent in military service.
Currently, an old-age labor pension is assigned to military personnel after discharge from military service. Except for persons who have served for at least 72 months from the date of re-enlistment in military service, persons reinstated in military service by a legally effective court decision, and persons who died while performing military service duties, including officers, the labor pension of pensioners who were re-enlisted and subsequently discharged after being assigned an old-age labor pension as military personnel may not be recalculated based on their latest maintenance allowance.
Under the draft, an old-age labor pension, as well as a monthly pension supplement, will be assigned to military personnel after discharge from military service.
Except for persons who have served for at least 72 months from the date of re-enlistment in military service, persons reinstated in military service by a legally effective court decision, and persons who died while performing military service duties, including officers, the labor pension of pensioners who were re-enlisted and subsequently discharged after being assigned an old-age labor pension as military personnel will not be recalculated based on their latest maintenance allowance, while the monthly pension supplement will not be recalculated based on their latest rank.
The procedure for providing information on income subject to compulsory state social insurance during the period of service of military personnel who served within the system of the body (institution) designated by the relevant executive authority and who have acquired the right to a labor pension, for the purpose of calculating the amount of the insurance component of their old-age and disability labor pensions, will be determined by the relevant executive authority.
The draft law was put to a vote and adopted in the third reading.
