Chairman of Supreme Court: “Only persons approved incompetent by court have no right to participate in the elections”

APA reports that Ramiz Rzayev delivered a speech on “Judicial protection of the rights and related judicial experience”.

Rzayev said that only persons approved incompetent by court have no right to participate in the elections. He said that suffrage can not be restricted in other cases under the law: “According to the Constitution, everyone has the right to appeal to the court. Azerbaijani citizens claiming the violation of suffrage can apply to the courts for their restoration.”


Rzayev noted that the Supreme Court can’t be applied directly. Voters, candidates, political parties, blocks, initiative groups have to appeal to the relevant courts.


Speaking about requirements of the law, Chairman of Supreme Court also noted that though the law is wide, life is rich: “There are some points that the law faces difficulty in commenting on them. Your decision may be legal. If you do not substantiate in the resulting part, it will be difficult to prove it and cause doubt”.


Rzayev also spoke about the cases considered regarding the elections in the Supreme Court: “In 2010, 168 cases were considered by the Supreme Court. The court upheld the decisions on 160 cases considering them legal and valid. 8 cases were considered illegal and abolished. New decisions were passed on 4 of them. Decisions of the court of appeal on 4 cases were abolished and sent to the court for reconsideration. 16 of cases considered in 2010 were related with municipal elections, 152 with parliamentary elections”.
