Court rejects ANS lawsuit against NTRC

The lawsuit against the NTRC’s decision dated Oct.5 on the suspension of “Salam AzÉ™rbaycan” program aired on ANS was considered at hearing, which was presided over by judge Museyib Bayramov.

Judge Mukhtar Mustafayev, a representative of ANS, said in his speech that the 10-day suspension of “Salam AzÉ™rbaycan” has caused material damage to the company.

“Citizens used to watch the program. This decision is unfair. The suspension also lowers the company’s ranking,” he said.

NTRC representative Toghrul Mammadov said the decision is based on legal grounds and that ANS’s lawsuit has no perspective.

“Our decision is intended to correct them. The council could have made a more drastic decision but it acted humanely so that the company may not be damaged a lot,” said Togrul Mammadov.

The judges then paused for pondering.

Note that, on September 30 the NTRC held a meeting during which the administrative proceedings on ANS’s violation of the law on television and radio broadcasting were reviewed. At the meeting, a decision was passed to suspend the program, which is aired on ANS TV channel at 07:00am-10:00am on Monday-Friday, and at 08:00am-10:00am on Saturday, for ten (10) days from 6 Oct. 2015.

ANS had appealed to Baku administrative-economic court No.1, with a lawsuit for the NTRC’s decision to be deemed illegal.
