Authorities that will impose administrative fines for unregistered grants have been determined, APA reports.
President of Azerbaijan, Ilham Aliyev, has signed a Decree in this regard.
Note that, in accordance with the Code of Administrative Offences, officials are fined between 2,500 and 5,000 manats, and legal entities between 5,000 and 8,000 manats, for carrying out bank transactions or any other operations under contracts (decisions) on the receipt (provision) of grants that have not been registered in the manner prescribed by the Law “On Grants” by recipients of the Republic of Azerbaijan, or by banks and other payment service providers.
According to the Decree, in such cases administrative offense proceedings will be considered by the Ministry of Justice with respect to individuals, as well as municipalities, municipal bodies, and other non-commercial entities (except religious organizations); by the Central Bank with respect to banks and other payment service providers; and by the Ministry of Economy with respect to other commercial legal entities and public legal entities.
According to the Code of Administrative Offenses, officials are subject to a fine of two thousand five hundred to five thousand manats, and legal entities are subject to a fine of five thousand to eight thousand manats for conducting banking transactions and any other transactions by non-governmental organizations or banks and other payment service providers under an agreement on the provision of services or performance of work at the expense of external financial sources that are not registered in accordance with the procedure established by the Law "On Non-Governmental Organizations (Public Associations and Funds)".
Under the Decree, in such cases administrative offense proceedings will be reviewed by the Ministry of Justice with respect to non-governmental organizations, and by the Central Bank with respect to banks and other payment service providers.
