Azerbaijan determines limit of liability for damage to baggage in air transportation

The limit of liability for damage to baggage and cargo in air transportation has been determined in Azerbaijan, APA reports.

This is reflected in the "Rules for the implementation of commercial air transportation, air transportation of passengers, baggage, cargo, and postal items" approved by the Cabinet of Ministers.

The procedure for calculating and paying compensation for damage to passengers, baggage, and cargo in connection with air transportation, and the limit of liability of the carrier for baggage or cargo registered without declaring its value accepted for transportation by carriers belonging to the Republic of Azerbaijan in domestic transportation of the Republic of Azerbaijan, have been determined.

According to the decision, the liability and the extent of the carrier's liability for damage to the life or health of an aircraft passenger, as well as to his or her property, are determined in accordance with the Civil Code and the Criminal Code, as well as international treaties to which the Republic of Azerbaijan is a party. The carrier is liable within the framework of the legislation for damage to the life and health of a passenger during boarding or disembarking operations on board an aircraft.

The carrier does not bear any liability for the death or deterioration of the health of a passenger resulting from any of his illnesses.

The carrier is liable for the loss, shortage, or damage to baggage and cargo in the amount of their actual value, but not exceeding the limits established by the regulatory legal acts specified in these Rules and international treaties to which the Republic of Azerbaijan is a party.

The carrier shall pay compensation for the loss, shortage, or damage of baggage and cargo in the following manner:

- for the loss, shortage, or damage of baggage and cargo with declared value accepted for air carriage - in the amount of their declared value;

- for the loss, shortage, or damage of baggage and cargo with undeclared value accepted for air carriage - limited to the amount of the special borrowing right established by the Convention "For the Unification of Certain Rules for International Carriage by Air", signed in Montreal on May 28, 1999.
