Azerbaijani parliament’s committee for statehood and legal policy holds next meeting

Baku. Elnur Mammadli – APA. The next meeting of Azerbaijani parliament’s committee for statehood and legal policy has been held today, APA reports. The draft on amendments and annexes to the law on “Prosecuting authority” was discussed at the meeting.

Sector chief of the parliament’s department for statehood and legal policy Ilgar Jafarov gave information about the draft. According to him, a number of new notions, terms have been included into the law, memory medals and badges instituted, proposals made concerning the tenure of prosecutors. As regards the tenure of prosecutors, article 4.16 of the law (One and the same person can not be reappointed Prosecutor General of Azerbaijan Republic, Military Prosecutor of Azerbaijan Republic, Prosecutor of Nakhchivan Autonomous Republic, Military Prosecutor of Nakhchivan Autonomous Republic. District and specialized prosecutors can not be appointed to these posts more than twice) has been amended.

The following amendment is offered to article 16 “As a rule, district and specialized prosecutors can not be appointed to these posts more than twice”. Ilgar Jafarov said compared with the previous variant only the expression “as a rule” was added to the article.

Draft laws on amendments to the law on “Service in prosecuting authorities” and “Labor pensions” were also discussed at the meeting.

Parliamentarians Fazail Agamali, Mubariz Gurbanli, Rafael Jabrayilov, Gudrat Hasanguliyev and others expressed their support for the draft law and underlined its importance for the improvement of prosecuting authorities.

Chairman of the committee Ali Huseynov said regular measures are being taken to improve the prosecuting authorities in the country.

Draft law on “Getting information about the activity of courts” was also discussed at the meeting. The draft consists of 5 chapters and 25 articles. It envisages future activities of judicial bodies to ensure transparency of courts.

Ali Huseynov said sometimes media reports about court hearings are regarded as influence on the trial.
“The presenter of a court-related program on one of the TV channels is a person who was once dismissed from judicial bodies for incompetence. But now he is teaching the rules for organizing hearings,” he said.

MP Gudrat Hasanguliyev said though the law aims to ensure transparency in the judicial system, it will not eliminate all problems in this field.
“United Azerbaijan Popular Front Party has prepared a draft law and submitted to the parliament. We offer to establish Judicial Council. If we want serious reforms in the judicial system, this process should begin from the Court-Law Council,” he said.

Fazail Agamali protested against the requirement in article 14 on secrecy of court reports about sexual minorities.

It was decided to discuss the abovementioned amendments and annexes, draft law in the plenary session of the parliament.
