Azerbaijan approves procedure on obtaining right to give grant by foreign donors

This decision was passed in order to ensure the execution of the subparagraph #2.2.3 of the Presidential decree of the Azerbaijani Republic dated November 14, 2014 of No. 344 "About application of the Law of the Azerbaijani Republic dated October 17, 2014 of No. 1081-IVQD "About modification of the Law of the Azerbaijani Republic”.

According to the decision, international organizations and their representations, foreign governments and their representations, international organizations of charitable, humanitarian and other social directions, financial - credit institutions, foreign public organisations including funds, associations, federations and committees carrying out activities in the field of development of education, science, health, culture and sport, and not being aimed at profit branches and representations of foreign legal persons, registered in Azerbaijan and not being aimed at profit (branches and representations of foreign NGOs registered in the Republic of Azerbaijan on the basis of the agreement which is envisaged in the Article 12.3 of the Law of Non-Governmental organizations(Public Associations and Foundations) of the Republic of Azerbaijan) of foreign legal entities may act as a donor after obtaining the right to give a grant in the Republic of Azerbaijan.

The requirements for foreign donors’ acquisition of the right to give a grant are also applied to grant agreements (orders), sub-grants, grant additions and amendments to them.

Grant agreement can’t be signed with foreign donors who have the right to give a grant.

These requirements are not applied to the grant agreements signed and approved by the Azerbaijani Republic and Government of the Azerbaijani Republic.
