Legal mechanisms to combat the financing of terrorism are being improved, APA reports.
This is reflected in proposed amendments to the Criminal and Criminal Procedure Codes discussed at today’s meeting of the Milli Majlis Committee on Legal Policy and State Building.
The draft law was prepared with the aim of strengthening mechanisms to combat the financing of terrorism (TF), more precisely defining the liability of legal entities in this area, as well as ensuring more effective implementation in national legislation of obligations arising from international treaties to which the Republic of Azerbaijan is a party and the relevant FATF standards.
An important difference between TF and other crimes of an economic nature is that the main purpose of this act is not to obtain financial or other economic benefit, but to direct funds toward financing a terrorist act, a terrorist organization, or the activities of a terrorist.
In this regard, the main objective in combating TF is not only to detect and confiscate illegal proceeds, but also to timely identify, prevent, freeze, and confiscate financial resources that may be used in terrorist activities.
The proposed regulation is consistent with the international obligations of the Republic of Azerbaijan and the objectives and requirements of FATF standards, while also serving to increase the effectiveness of national legal mechanisms in the field of preventing TF.
Other amendments presented in the draft are essentially of an alignment nature, taking into account the specifics of proceedings for holding legal entities liable.
