Sanctions are changing for illegally acquiring, transferring, selling, storing, transporting, or carrying weapons, their components, ammunition, explosives and devices in Azerbaijan, this was reflected in the proposed amendment to the Criminal Code, which was discussed at today's meeting of Milli Majlis (Parliament) of Azerbaijan, APA reports.
Thus, Article 228 of the Criminal Code, regarding the illegal acquisition, transfer, sale, storage, transportation or carrying of weapons, their components, ammunition, explosives and devices, is being reworded.
According to the draft law, illegal acquisition, transfer, storage, transportation, or carrying of firearms, their components, ammunition (except for smooth-bore hunting weapons and ammunition for such weapons), explosives and devices will be punished by corrective labor for a term of up to two years, or restriction of freedom for a term of two to three years, or imprisonment for a term of up to three years. If the specified acts are committed by a group of persons in advance, by an organized gang, if they are committed repeatedly, or if they are committed by a person using his or her official position, they will be punished by imprisonment for a term of three to five years.
Illegal sale of firearms, their components, ammunition (except for smooth-bore hunting weapons and ammunition for such weapons), explosives and devices shall be punishable by imprisonment for a term of four to eight years. The specified acts shall be punished by imprisonment for a term of five to eleven years if they are committed by a group of persons, an organized gang or a criminal association (organization) in advance, if they are committed by a person using his or her official position, if they are committed repeatedly, if they are committed using the media, including Internet information resources or information and telecommunication networks.
Illegal acquisition, sale or carrying of gas weapons, cold weapons, including cold shooting weapons, except for cases of carrying of cold weapons in areas considered as national costume or in connection with the hunting profession, shall be punished by community service for a term of three hundred and twenty to four hundred hours, or corrective labor for a term of up to two years, or restriction of freedom for a term of up to one year, or imprisonment for a term of up to one year.
A person who voluntarily surrenders the items specified in this article shall be exempted from criminal liability if his or her actions did not constitute another criminal offense.
It should be noted that, according to the current law, illegally acquiring, transferring, selling, storing, transporting or carrying firearms, their components, ammunition (except for smooth-bore hunting weapons and ammunition for such weapons), explosives and devices is punishable by corrective labor for a term of up to two years, or restriction of freedom for a term of one to three years, or imprisonment for a term of up to three years.
If the same acts are committed by a group of persons in prior collusion, they are punishable by imprisonment for a term of three to five years in case of repeated commission.
If the above-mentioned acts are committed by an organized group, they are punishable by imprisonment for a term of five to eight years. Illegally acquiring, selling or carrying a gas weapon, cold weapon, including a cold-shooting weapon, except for carrying a cold weapon in areas considered as national clothing or in connection with the hunting profession, is punishable by three hundred and twenty to four hundred hours of community service or correctional labor for a term of up to two years or restriction of freedom for a term of up to one year or imprisonment for a term of up to one year.
A person who voluntarily surrenders the items specified in this article shall be exempted from criminal liability if his or her actions did not constitute another criminal offense.
The draft law was put to a vote and adopted in the first reading.
