Azerbaijan extends maximum term of administrative arrest by 6 times

 According to the amendments made to the Code of Administrative Offences at today’s meeting of Parliament, in exceptional cases, administrative arrest for the different types of administrative violations has been extended to 3 months from 15 days.

 

Huseynli said that a number of acts envisaged in the administrative legislation are considered criminal liability in Europe: “Extension of the administrative arrest up to 3 months is logical and humane step, because it is not considered criminal liability.”

 

According to the amendments, administrative punishment for beating was tightened. Under the amendments made to 38-1 article of the Code of Administrative Offences, AZN 500-1000 will be imposed for beating or intentionally inflicting physical pain with other violent acts and 2-month administrative arrest (at present 15 days) is considered for the severity of the offense and taking into account the personality committed misconduct.

Fines from AZN 50 up to AZN 80 are set for robbery, embezzlement, wastefulness, abuse of power or swindling, administrative arrest up to a month (currently up to 15 days) will be applied if the abovementioned measures are considered insufficient.
