European Court makes one more decision on Azerbaijan

The applicants are ten Azerbaijani nationals, holders of vouchers for flats which are currently occupied by internally-displaced families from regions under the control of Armenian military forces, following the Nagorno-Karabakh conflict. The applicants complained about the non-enforcement of domestic court judgments which had ordered the occupants’ eviction. They relied in particular on Article 6 § 1 (right to a fair hearing) and Article 1 of Protocol No. 1 (protection of property) to the European Convention on Human Rights. Violation of Article 6 § 1 (fairness) Violation of Article 1 of Protocol No. 1 Just satisfaction: enforcement of the judgments in favour of the applicants within three months, and: - pecuniary damage: 2,500 euros (EUR), each, to the first nine applicants and EUR 7,000 to the 10th applicant - non-pecuniary damage: EUR 1,200, each, to the first nine applicants and EUR 3,000 to the 10th applicant - costs and expenses: EUR 2,000, jointly EUR 45 300.
