Strasbourg. Fuad Gulubeyli - APA. The Grand Chamber considered admissible this complaint and the case was taken to the execution. The court will deliver its judgment at a later date.

The case concerns the complaints by Azerbaijani IDPs, they were forced to flee from their homes in 1992.
The applicants- Fakhraddin Pashayev, Ramiz Jabrayilov, Saghatel Jabrayilov, Akif Hasanov, Adishirin Chiragov and Elkhan Chiragov complain in particular about their loss of the properties in Lachin, as well as various other possessions. The applicants rely on Article 1 of Protocol No. 1 (protection of the property) and Articles 8 (right to respect to private and family life ) and 13 (right to an effective remedy ) of the European Convention on Human Rights.

Finally the applicants claim, under Article 14 (prohibition of discrimination) of the Convention in conjunction with all the above Articles, that, if they had been ethnic Armenian and Christian, they would not have been forcibly displaced from their homes by the Armenian forces and that their property rights would have been recognized and their complaints investigated.

The application was lodged with the European Court of Human Rights on April 6, 2005.
European Court of Human Rights, Grand Chamber also declared admissible the issue of Minas Sargisyan against Azerbaijan.
