Known why adoption of Law on Defamation delays in Azerbaijan

In his interview to APA Ali Huseynli announced the problem that directly causes the delay, spoke about the moments causing different position of the committee chaired by him. He said lack of clarification of this different position last year delayed the adoption of the law.

“It concerns the removal from the Criminal Code of articles 147 and 148 envisaging arrest over slander and insult. They demand the removal of these articles in order to adopt the law, while we see no need for it. As observed, no journalist has been arrested under this article in recent years, maintenance of these articles does not mean that they will be applied. Every law has its function. The disputable articles are rather of preventive character. In recent years, journalists have not been arrested in our country over this. Therefore, we consider that the Law on Defamation can be adopted without removing these articles from the Criminal Code. The main cause of the delay is the different positions over these articles,” he said.

The government of Azerbaijan and the Venice Commission of the Council of Europe are holding discussions on the draft law. The sides held a meeting within the framework of the plenary session of the Venice Commission in December, 2012.
