President Ilham Aliyev has approved the law on amendments to the Civil Procedural Code of the Republic of Azerbaijan.
Under the amendment, in the cases prescribed by the law on citizenship, the relevant executive authority informs court of the loss of the person’s citizenship.
The application must show the reasons for the person’s loss of citizenship, and the reasoned opinion of the relevant executive authority and related documents must be attached to the application. The application is reviewed in 10 days after being received by court.
The participation in review is necessary of the representatives of the state body conducting the investigation into the facts of deprivation of nationality. Taking into account the limits set out in the second and third parts of Article 17 on Citizenship of the Republic of Azerbaijan", the judge should adopt a resolution on denying or considering the application.
Note that limitations are mentioned in the second and third parts of Article 17 of the Law on Citizenship of the Republic of Azerbaijan". In other words, an application for renunciation of citizenship may be denied if the person applying for renunciation of citizenship of the Republic of Azerbaijan does not fulfill its obligations to the state or property obligations related to the interests of individuals and legal entities in the Republic of Azerbaijan. If the person applying for renunciation of citizenship of the Republic of Azerbaijan is attracted as a defendant in the criminal liability or there is a verdict that has entered into force or is enforceable against him, or the person’s deprivation of citizenship is contrary to national security interests of the Republic of Azerbaijan, his renunciation of citizenship is not permitted to resolve these cases.
