The Government of Azerbaijan appeals ECHR decision on Eynulla Fatullayev before the Grand Chamber of the European Court

Baku. Hafiz Heydarov – APA. The Government of Azerbaijan appeals the decision of the European Court of Human Rights on Eynulla Fatullayev before the Grand Chamber of the Court, Azerbaijani representative at the European Court of Human Rights Chingiz Asgarov told journalists. He said according to Article 43 of the European Convention on Human Rights, following every decision of the European Court, it should be reviewed by the Supreme Court Plenum within three months. The Government of Azerbaijan expressed its dissatisfaction with the ECHR decision and has already appealed it before the Grand Chamber.

On April 22, 2010, considering the Fatullayev’s appeal against Azerbaijan, the European Court of Human Rights passed decision where it noted that it had found it as violation of the Convention of Human Rights and Freedoms and demanded Azerbaijan to release Fatullayev immediately.

Eynulla Fatullayev was arrested on April 20, 2007 and later he was sentenced to eight-and-a-half-year imprisonment for threat of terrorism, incitement to ethnic hostility and tax avoidance. 0.223 g heroin was found on Eynulla Fatullayev in jail #12 on December 30, 2009. As a result of biological-chemical examination, heroin and a psychotropic substance were found in Fatullayev’s blood and urine examples. He faced charges under Article 234 (illegal manufacturing, purchase, storage, transportation, transfer or selling of narcotics, psychotropic substances) of the Criminal Code and sentenced to two-and-a-half-year imprisonment by Garadagh district court.
