Baku. Ramiz Mikayiloglu – APA. The imprisoned chairman of REAL Movement Ilgar Mammadov has lost his right to be elected MP, Shahin Asadli, head of the media and PR department of Azerbaijan’s Central Election Commission, told APA on Thursday.
“His collecting signatures and presenting them to a constituency will not count any more. Even if the documents are presented [by him], the constituency will remind him of the enacted court verdict and his deprivation of the right to be elected MP,” Asadli said.
Asadli said that Azerbaijani citizens have active and passive suffrage provided by law. “On April 25, documents of Ilgar Mammadov’s nomination were submitted to Agdash Precinct Election Commission #90. The CEC reviewed the documents and provided necessary assistance to him,” he added.
Asadli recalled that Ilgar Mammadov’s nomination was approved on April 28 and his representatives were given relevant election documents.
“Earlier, Ilgar Mammadov had passive suffrage. On April 29, the Shaki Court of Appeal issued a verdict against Ilgar Mammadov. Under the Article 13.3.1 of the Electoral Code, Ilgar Mammadov lost his passive suffrage as well”, he noted.
The Shaki Court of Appeal held a hearing on the appeals filed by the imprisoned chairman of REAL Movement Ilgar Mammadov and the deputy chairman of Musavat Party Tofig Yagublu on April 29.
The court rejected petitions for the acquittal of Ilgar Mammadov and Tofig Yagublu, upholding the decision of the court of first instance.
The Shaki Court of Grave Crimes sentenced Ilgar Mammadov to 7 years and Tofig Yagublu 5 years in prison.
The Shaki Court of Appeal rejected the appeal against the judgment. Then they filed a cassation appeal to the Supreme Court.
The Supreme Court partially upheld the cassation appeal. The decision of Shaki Court of Appeal on the case of Ilgar Mammadov and Tofig Yagublu was cancelled and the case was sent to Shaki Court of Appeal for reconsideration.
Ilgar Mammadov and Tofig Yagublu were arrested over the events in Azerbaijan's Ismayilli district. Tofig Yagublu was released in March under the presidential pardon order.
