Azerbaijanâ€™s Civil Code amended due to purchase of lands for government needs

According to the amendment, the lands could be purchased for government needs in accordance with corresponding decisions of executive authorities for the construction of roads and communications, security of state borders, construction of defense and security facilities, significant mine facilities.

According to the Codeâ€™s article 157.9, the lands are purchased for government needs in accordance with the corresponding decisions of executive authorities and within the relevant law.

The amendment reads that the executive authorityâ€™s decision should be officially registered and authorities should inform the land owner in written form. The owner receives payment in 90 days after the signing of deal.

According to the articles 246-249, it covers also the facilities (water reservoir, forests, multi-year cultivations, constructions, installations and other facilities) located in the purchased area or nearby area.
