European Court passes judgment regarding Ali Kerimli, Arif Hajili, Sardar Jalaloglu and Gulamhuseyn Alibeyli

Lawyer Esabeli Mustafayev told APA that according to the judgment, Article 3 (right to free elections) and Article 14 (discrimination) of the European Convention on Human Rights were violated. According to the judgment, EUR 7,500 (non-pecuniary damage) and EUR 1,600 (costs and expenses) are to be paid to Arif Hajili; EUR 20,000 (pecuniary damage) to Ali Kerimli, EUR 7,500 (non-pecuniary damage) to each of the applicants and EUR 3,000 (costs and expenses) jointly to both applicants in the case of Kerimli and Alibeyli; EUR 7,500 (non pecuniary damage) and EUR 1,600 (costs and expenses) to Sardar Mammadov.

The applicants complained about the invalidation of the results of the November 2005 national parliamentary elections in which, they claimed, they were the outright winners in their respective constituencies.
