Azerbaijani parliament adopts law on security of ex-presidents and their families

Since there is no such a case in Azerbaijan, this law is applied to all ex-presidents,” chairman of the parliament’s committee on legal policy and statehood Ali Huseynli said while giving information about the draft law, APA reports.

Chairman of the committee also commented on the parliamentarians’ proposals to grant an allowance to the ex-presidents amounted to 80% of the salary of incumbent president. Ali Huseynli said the monthly amount of the allowance is approximately AZN 7500-8000. This equals to 70-80% of the salary of the incumbent president. The opinion of the financial examination concerning the allowances is positive.

MP Igbal Agazadeh objected to the dismissal of Rafig Aliyev from the State Oil Academy. He called on the parliament’s administration to appeal to rector of the State Oil Academy to correct the mistake.

MP Aydin Mirzazadeh underlined that the draft law met the international requirements.

MP Gudrat Hasanguliyev said implementation of the law concerning the former president Ayaz Mutallibov would create other problems in the future. He said Ayaz Mutallibov was charged with the actions committed after the ending of his presidential authorities: “Mutallibov is charged with grave crimes”.

MP Jale Aliyeva said a separate law must be elaborated concerning the late president of Azerbaijan Heydar Aliyev: “A group of parliamentarians, including me, are working on such draft law”.

MP Fazil Mustafa called the above-mentioned draft law as the important and democratic one. He said it creates an opportunity for the political dialogue in the country. He also made comments on the proposals by some lawmakers that Ayaz Mutallibov should apologize to Azerbaijani people. “Thereat the head of state and we, the lawmakers, should every morning apologize to Azerbaijani people that we can’t regain Karabakh”.

Fazil Mustafa defended Academician Rafig Aliyev too. He said the Academician is world-renowned scientist and called on the Oil Academy’s authorities to eliminate their mistake soon.

MP Zahid Oruj noted that Mutallibov could use this law to file an international lawsuit and to demand compensation from Azerbaijan. He said he was against this law.

Following the discussions, the law passed the third reading.

The draft law consists of 12 items. “Former president” is considered the person, who was President of Azerbaijan Republic, was President and died, and the person, whose authority was terminated in line with article 104 of the Constitution. The law also contains notions of president’s spouse and dependent children. This notion envisages the president’s child under 18, the dependent child, including adopted child or stepchild.

According to the law, the pension of former president is equal to the 50 percent of the monthly salary of the incumbent president. According to article 107 of the Constitution, the president ousted in terms of impeachment, has no right to get this pension.

The document also covers the allowance for the spouse of the deceased president and dependent family member. After the death of former president, allowance in the amount of 50 percent of the monthly pension is to be paid to the spouse or to the dependent child. If former president dies in office, the allowance equal to the president’s pension is to be paid to the spouse or dependent child. If there is more than one dependent child, the allowance will be paid to them after being divided into equal parts.

According to the law, the pension and the other payments must be paid to the ex-president from deserting his presidential post till his death. If the ex-president dies, it must be paid to the spouse of the ex-president, to the child until he or she reaches 18. In general, the payment of pension and grants and other provisions will be considered in the state budget. The pension and grants paid to the ex-presidents are free from tax.

The clauses of any law and rules on medical supply determined for civil service will also concern ex-president and his (her) family members.

The law considers to give 3 security staffs, one driver, one service car, the payment of representation expenses in amount of 20% of monthly salary of person, who is in the presidential post, and to give a diplomatic passport for life to ex-president and his (her) spouse.

Ex-president can not be brought to administrative or criminal responsibility for the acts made before his (her) election or during fulfilling its obligations. His (her) spouse will not be brought to the demonstrative and criminal responsibility for the acts made by ex-president during the period of fulfilling the obligations or previous periods. Ex-president can’t be brought to responsibility, detained, examined without the consent of the General Prosecutor except the detention on the scene of the crime.

According to the law, the archive consisting of copies of personal correspondence documents is kept in ex-president’s order.

The parliament approved the draft law in the first reading on October 25.
