Ali Huseynov: “Azerbaijani Parliament received draft law on lifting restriction imposed on election of Prosecutor General more than twice”

He said the parliament’s present schedule was very heavy and added:
“We will consider the by the end of the extraordinary session, if we have time. If we do not have time the issue will be considered later,” he said.

Ali Huseynov said the draft did not mean to prolong the tenure of any person. The proposal aimed to lift the formal restriction.
“The proposal presented in the draft is not grounded. I consider that there is no need for such a restriction. The process of democratic choice is not violated here. The head of state nominates the candidate and the parliament confirms. This is not the model of prosecutor for life. Prosecutor is again elected for a five-year term,” he said.


It is offered to remove the sentence “One and the same person can not be appointed Prosecutor General of Azerbaijan Republic, Military Prosecutor of Azerbaijan Republic, Prosecutor of Nakhchivan Autonomous Republic more than twice” from the 2nd part of Article 16 of the law on “Prosecutor’s office”.

According to the law on “Prosecutor’s office”, restriction was imposed on election of Azerbaijan’s Prosecutor General, Military Prosecutor and Prosecutor of Nakhchivan Autonomous Republic. One and the same person can be elected to these posts only twice for a five-year term.

Azerbaijan’s Prosecutor General Zakir Garalov was appointed to the post on April 25, 2000, his tenure will expire on April 25 next year.

Military Prosecutor Khanlar Valiyev was appointed to the post on February 10, 2005.

Prosecutor of Nakhchivan Autonomous Republic is Shahverdiyev Sabuhi Zehmet.
