Azerbaijan to establish "ICMAL" information system on administrative offences

An "ICMAL" information system will be created regarding administrative offenses, APA reports.

This is reflected in the new Articles 45-1 and 45-2 added to the Code of Administrative Offenses approved by President of Azerbaijan Ilham Aliyev. 

Decisions without a unique number will not be enforceable

To ensure the tracking of administrative offense protocols and administrative offense decisions (court orders), including electronic protocols and electronic decisions, by assigning a unique number, these documents will be transferred to the "ICMAL" information system. Decisions on administrative offense cases that provide for the imposition of an administrative penalty in the form of a fine, including electronic decisions, cannot be requested to be executed (including the calculation of fines) without being assigned a unique number through the "ICMAL" information system.

5% of fines will be directed to the maintenance of the “ICMAL” system

In order to maintain the “ICMAL” information system, as well as to strengthen the social protection and improve the material security of employees of the body (institution) determined by the relevant executive authority, 5% of the funds received by the state budget from fines imposed under this Code will be transferred to the treasury account of that body.

The procedure for transferring information on protocols on administrative offenses and decisions (resolutions) on administrative offense cases to the “ICMAL” information system has also been determined.

Information on administrative offense protocols and decisions (resolutions) on administrative offense cases entered into the information system of the authorized body will be immediately transferred to the "ICMAL" information system.

It is also planned to integrate court decisions into the "ICMAL" system

The transfer of information regarding the decision on the administrative offense case issued by the court to the "ICMAL" information system will be carried out in the prescribed manner.

Information on lost and unverified documents shall be transmitted to the system within 24 hours

Information on lost, damaged (ruined) forms, as well as documents not approved after being assigned a unique number in accordance with the procedure provided for in Article 45-2.3 of this Code or not printed on numbered forms, will be transferred to the "ICMAL" information system immediately, but in any case no later than 24 hours from the time of their compilation.
