Administrative procedures for extending the temporary stay of foreign nationals in Azerbaijan will be digitized under the proposed legislative amendments, APA reports.
The proposal is included in amendments to the Migration Code, the laws "On Registration at the Place of Residence and Place of Stay" and "On State Duty", which were discussed today at a meeting of the Azerbaijani parliament's Committee on Legal Policy and State Building.
Under the proposed changes to the Migration Code, decisions on extending the period of temporary stay will be issued electronically instead of on paper. Once the state fee is paid, the decision will be uploaded to the applicant's electronic cabinet in the Electronic Government Information System and sent to their registered email address.
The amendments also provide for the electronic authentication of the decision, its certification with an electronic signature, and clarification of the legal framework governing electronic services.
In addition, amendments to Article 43 of the Migration Code introduce a new ground for refusing an application to extend a temporary stay. Failure to submit one or more of the documents required under Article 41.1 of the Code will now constitute a legal basis for rejection.
The draft law also includes a terminological amendment to the law "On Registration at the Place of Residence and Place of Stay." Amendments to the law "On State Duty" stipulate that no state fee will be charged for the reissuance of a decision extending a foreigner's temporary stay.
A transitional provision has also been added to the draft legislation. Under this provision, decisions extending temporary stay that were issued before the law enters into force will remain legally valid until their expiry date.
If such decisions are lost, destroyed, damaged, or if the personal details in a foreign national's identity documents change, they will be reissued electronically, uploaded to the applicant's electronic cabinet in the Electronic Government Information System, and sent to the applicant's email address. No state fee will be charged for reissuing the decision in these cases.
Lawmakers noted that the proposed amendments are intended to support the digitalization of public services, simplify document processing, expand the use of electronic procedures, improve the efficiency of administrative processes, and align legislation with the principles of e-governance.
