Rules are establishing for handling domestic violence complaints without criminal elements, APA reports.
This is reflected in the proposed new version of Article 9 of the law "On the Prevention of Domestic Violence," which was discussed at today's meeting of the Human Rights Committee of the Milli Majlis (Azerbaijani Parliament).
Noted that when there are no criminal elements in a domestic violence complaint, the "Rules for Handling Complaints about Domestic Violence" were approved by the Cabinet of Ministers' decision No. 46, dated February 24, 2012. Currently, this procedure is carried out according to the rules for handling complaints when there are no criminal elements in domestic violence cases.
The draft includes a new version of Article 9 (on the results of handling domestic violence complaints in accordance with Article 5.2 of this law), providing a more detailed procedure for handling incoming applications related to domestic violence.
Specifically, the draft law outlines the time frame for handling domestic violence complaints, the authority responsible for reviewing the complaints, the scope of individuals to be invited during the review process—including the use of services from lawyers, psychologists, and interpreters—and ensuring the participation of psychologists and educators when interviewing minors or individuals with disabilities. It also includes the final decisions regarding the outcomes of handling domestic violence complaints.
