ANSâ€™s appeal against NTRC to be considered in Baku Administrative Economic Court No. 1

Baku Court of Appeal investigated ANS Independent Broadcasting Media Company’s appeal on “considering the administrative act invalid” (the decision dated 18 July 2016 on temporary suspension of broadcasting) at the hearing presided over by judge Elshane Valiyeva whether or not it concerns the court, APA reports.

ANS’s lawyer Ragif Mustafayev said that the case should be considered in Baku Court of Appeal “Thus, ANS’s case related to its program “Salam, AzÉ™rbaycan” and its other cases have been considered in this court as well”, he said.

NTRC representative Togrul Mammadov noted that the case has to be taken care of by Baku Administrative Economic Court No.1, on that basis that the complaint is about an administrative act.

ANS President Vahid Mustafayev said all the cases with ANS are considered by the Baku Court of Appeal.

“We’re not talking about a culprit. We’re talking about a company that has served the state and the people for 25 years. We have more than a thousand employees who are in troubled social situation. For all these reasons, let the case be considered by the Baku Court of Appeal,” he said.

The judges paused for consultation and then announced a verdict, according to which the case will be considered by Baku Administrative Economic Court No.1.

In order to prevent provocative actions aimed at violation of the strategic partnership between Turkey and Azerbaijan, and the open propaganda of terrorism, guided by the appeal of the Prosecutor General of the Republic of Azerbaijan dated July 18, 2016 and the requirements of Art. 11, 23, 32 of the Law of Azerbaijan Republic "On Television and Radio Broadcasting", the National Broadcasting Council has decided to suspend broadcasting activity of ANS TV for a month from 18:30 of July 18, 2016, as well to initiate an action to revoke the license No.TR 099 dated October 25, 2013, the cancellation of the license No. TR 100 given to by ANS TV on October 25, 2013 in accordance with Art. 23.2.8 of the Law of Azerbaijan Republic "On Television and Radio Broadcasting".

After that NRTC applied to the Baku Court of Appeal in connection with the cancellation of the license of the "ANS Independent Broadcasting and Media".
