Court completes investigation on Ali Insanovâ€™s case

Baku. Shahriyar Alizadeh – APA. Baku Court of Appeal continued hearing on the case of former Azerbaijani Minister of Health Care Ali Insanov.

APA reports that public prosecutor asked to complete the investigation at the hearing presided by judge Gadim Babayev. Insanov’s lawyers protested against the unfinished investigation. The judge sustained the appeal of public prosecutor and passed a judgment to complete the investigation. Break has been announced at the hearing. The public prosecutor will deliver a speech after the break.

The judgment of the European Court of Human Rights (ECHR) on the former Azerbaijani Minister of Health Care Ali Insanov was considered at the Plenary Meeting of Supreme Court. According to the decision passed at the Plenary Meeting the judgments of Court of Appeal and Supreme Court on Ali Insanov were abolished. The judgment passed by the court of first instance remained unchanged and Ali Insanov wasn’t released. The case was sent to Baku Court of Appeal for reinvestigation.

On March 14, 2013, the European Court of Human Rights announced its judgment on the appeal of Ali Insanov, the former health minister of Azerbaijan. According to the judgment, Ali Insanov’s appeals on article 3 (prohibition of torture and of inhuman or degrading treatment), Article 6 § 1 and 3 (right to a fair trial) of the European Convention on Human Rights were ensured. Under the judgment, the Azerbaijani government is to pay € 10 000 compensation to Ali Insanov.
