Chairman of Supreme Court’s Board explains why European Court, in case of Ali Insanov, has passed a decision against Azerbaijan

Baku. Shahriyar Alizadeh – APA. “Sometimes courts violate the law,” said chairman of the Supreme Court’s Board on criminal cases Shahin Yusifov addressing the meeting of the Public Union of General Court's Judges, APA reports.

 

Yusifov said that there are a number of problems related to pre-trial detention: “Courts sustain 98 per cent of requests of prosecutor’s offices on pre-trial detention. We demand that this issue should be solved within the law in accordance with the international conventions. Chairman of the Supreme Court Ramiz Rzayev also thinks if the European Court passes a decision against Azerbaijan, the judge, who has violated the law, should give an explanation at a plenary meeting. In fact, judge has rejected the petition to call an additional witness regarding Ali Insanov’s case, therefore the European Court has passed a decision against Azerbaijan.”

 

The chairman noted that the court must establish the truth: “The case should be investigated objectively. Unfortunately, the courts generally sustain the petitions of prosecutors. If a judge can not independently make a fair decision, he or she should resign.”
