A civil claim has been filed in the ongoing trial of Oleg Krapivin, a Ukrainian millionaire known in the criminal world as “Oleg Bakinski,” who was arrested in Azerbaijan on hooliganism charges, along with Konstantin Kucher, APA reports.
The latest hearing was held today at the Baku Court on Grave Crimes under the chairmanship of Judge Elnur Nuriyev.
At the hearing, the lawyer of the victim, Samir Isayev, stated that based on documents submitted by Valeriy Zakharenkov, there has been no reconciliation between the parties. He noted that the accused have neither apologized nor expressed remorse.
The victim is demanding 50,000 AZN from both defendants jointly for moral damages in addition to material losses. Isayev emphasized that Zakharenkov, as a businessman visiting a local establishment, was subjected to disrespect.
Kucher’s lawyer claimed that there were procedural violations during the preliminary investigation. However, the prosecutor said such matters are addressed during preparatory hearings and that evidence discussed in court would be treated as valid.
During the session, the court reviewed the civil claim. The victim’s lawyer asked the court to accept both material and moral damage claims.
In response, Kucher’s lawyer Elshad Hajiyev argued that his client had no intent of embezzlement or fraud and had attempted to fulfill contractual obligations. He cited factors beyond Kucher’s control—such as the closure of "Gunay Bank" and border restrictions—as obstacles.
Oleg Krapivin objected to the claim, stating, “These people are framing me. I won’t pay even 5 manats for made-up hooliganism, let alone 50,000.”
Kucher also rejected the civil claim.
The trial was postponed until May 26.
Note that "Oleg Bakinsky" was arrested in Baku last year for alleged hooliganism against a Russian citizen. He was charged under Article 221.3 of the Criminal Code (hooliganism committed with the use of weapons or objects used as weapons, accompanied by violence against the victim or destruction/damage of another's property). A pretrial detention measure was imposed against him.
Later, he was also charged under Article 178.4 of the Criminal Code (fraud committed causing particularly large financial damage).
Alongside "Oleg Bakinsky," Konstantin Antonovich Kucher, who served as Ukraine’s Deputy Minister of Defense Industry for Aviation Affairs in 2010-2011, has also been found guilty in the case.
The victims in the case are identified as "Aviazapchast" JSC, "Promyshlennye Postavki Kazakhstan" LLC, and Zakharenkov Valeriy Nikolayevich.
