Azerbaijani court moves forward with trial of two men accused of hostage-taking and planning to seize customs post

A preliminary court hearing has been held in the criminal case launched by the State Security Service (SSS) against Fakhraddin Shahmurov and Jalal Muradov, who are accused of treason and creating an extremist group that planned acts of sabotage and hostage-taking, APA reports.

During the hearing at the Baku Court on Grave Crimes, under the chairmanship of Judge Elmin Rustamov, personal details of the defendants were clarified.

Although Fakhreddin Shahmurov received his secondary education in the Azerbaijani language, a Lezgi-language interpreter was also provided for him.

Later, Jalal Muradov's lawyer filed a motion requesting that the pre-trial detention measure applied to his client be replaced with house arrest.

The public prosecutor proposed not to change the preventive measure.

Fakhreddin Shahmurov’s lawyer requested that the case be returned to the investigative body that conducted the preliminary investigation. He based this request on the fact that during the preliminary investigation, his client was not provided with a translator from the Lezgi language.

The public prosecutor, referring to the fact that the accused was able to write a poem titled "Dagestan"—which is included in the list of evidence—in fluent Azerbaijani, and that he understood what was being said during the proceedings, proposed that the motion not be granted.

The motions were not granted.

According to the court’s decision, the criminal case has been submitted for trial, and a hearing is scheduled for October 6.

The following sessions will be held behind closed doors.

Note that through complex operational-investigative measures carried out by the State Security Service, it was established that citizens of the Republic of Azerbaijan - Shahmurov Fakhraddin Haji oglu, born in 1984, Muradov Jalal Muraj oglu, born in 1960, Babayev Kamran Kamil oglu, born in 1998, and others - conspired to create a criminal group with the aim of committing grave and especially grave crimes against the foundations of the constitutional order of the Republic of Azerbaijan, and prepared to commit sabotage acts against state institutions on the territory of the Republic by organizing secret meetings and various closed groups on social networks. 

It was determined that during a secret meeting organized with the participation of a foreign citizen, it was announced that criminal organization’s flag was composed which was later presented to Fakhraddin Shahmurov to enable him to lead the development of plans and conditions for crimes to be committed in the name of the goals of the organization.

A sabotage plan elaborated by Fakhraddin Shahmurov together with other members of the criminal group, to seize a customs post located on the state border of the Republic of Azerbaijan in an organized group in order to damage the country's defense capability and economic security and to take hostage the employees and other persons serving there in order to put forward the demands of the criminal organization, however the illegal actions of the organized group were prevented by the undertaken measures.

The State Security Service (SSS) has filed final charges against Fakhraddin Shahmurov under the following articles of the Criminal Code of the Republic of Azerbaijan: 28.215.3 (preparation for taking hostages), 218.1 (creating a criminal organization), 274 (treason), 281.3 (public calls against the state at the instruction of foreign organizations and their representatives), 281-1.3 (possession and carrying of attributes aimed at demonstrating the disintegration of Azerbaijan’s territorial integrity at the instruction of foreign organizations and their representatives), and 28, 282.2 (preparation for sabotage by an organized group).

Jalal Muradov has been charged under articles 218.2 (participation in a criminal organization) and 281.2 (public calls against the state by a group of persons) of the Criminal Code.
