Zakir Garalov: With the view of strengthening anti-corruption measures new divisions were set up at the Department to Combat Corruption under Prosecutor General of Azerbaijan
Zakir Garalov also spoke about the significant changes in the structure of the Department to Combat Corruption under Prosecutor General of Azerbaijan.
“Under the decree issued by President of Azerbaijan on March 11, 2011, the number of the workers of the Department to Combat Corruption under Prosecutor General of Azerbaijan increased by 60 and reached 100. On March 18, 2011, Azerbaijani parliament made changes to the laws on “Criminal investigation†and “Prosecuting authoritiesâ€, Department to Combat Corruption under Prosecutor General was empowered to carry out criminal investigation. The changes aiming to ensure successful fulfillment of the forthcoming tasks created opportunities to increase the number of the assistants of the department chief. With the view of fulfilling the tasks related to the normative-legal acts for strengthening struggle against corruption, an order was signed on May 12, 2011, to improve the structure of the Department to Combat Corruption under Prosecutor General, to confirm the regulations of the structures of the department. According to the order, four new divisions were set up at the department, new divisions were founded on the basis of the two cancelled divisions, the number of the divisions at the department reached 7,†he said.
Prosecutor General spoke about the main point of amendments in legislation on operational-search activities: “According to these amendments, the operational-search measures on corruption crimes will be taken by on Department to Combat Corruption under Prosecutor General of Azerbaijan. These measures may be taken by other subject of operational-search activities only in accordance with written instructions of Department to Combat Corruption under Prosecutor General of Azerbaijan. Control to the execution of law during the implementation of operational-search activity of specialized anti-corruption prosecutorial agencies will be conducted by Prosecutor General of Azerbaijan. This amendment will simplify the coordination of anti-corruption measures and control to the implementation of operational measures in accordance with legislation, in this sphere. At present, certain works are being conducted on acquisition of newly-established Operation and Operation Providence departments with skilled and experienced personnel. Recruitment of these departments’ personnel are planned to be held via competition. At the same time, the measures on supply of these departments with modern equipments are being takenâ€.
Speaking about the activities of newly-established departments in Department to Combat Corruption under Prosecutor General Z. Garalov noted that the preventive measures in combating anti-corruption had important significance: “According to experience, taking of preventive measures through determining of areas more exposing to corruption, learning of reason and condition for law-violations and suggestions to the relevant agencies for elimination of them are important issues in the elimination of these crimes. Taking the importance of preventive measures in combating anti-corruption sphere and preliminary investigations on corruption law-violations, including conduction of works on information provision by newly-established other department into consideration, Preventive Measures and Investigations Department was established in the base of Analytic-information office. Internal Security Service was established in the base of office’s Internal investigations department in accordance with the activity directions in modern condition and taking of measures for elimination and revealing of crimes on corruption in prosecutorial agencies, as well providence of launce of criminal case, protection of work places and technical facilities from information leakage, including revealing of facilities using for extraction of information and rendering harmless of them. Besides, Organizational and Information Provision Department was established for getting necessary information from information bases, information systems and registers of other state and non-state bodies which planned to be joined the Office, control to justification of received appeals in staffs on getting of these information, preliminary investigation of difficult corruption law-violations in accordance with office’s status and elimination of times-loss during investigation of crimes covering different spheres, finding of relevant legislation acts for prosecutor and investigator for providence of quickness of criminal prosecution and conduction of methodically assistance in providence. At the same time, Specialists Group was established as a department for management of Unique Information Base on crimes related to corruption.
Speaking about the taking the recommendations of international organizations, as well GRECO and OECD into consideration during the amendments in Department to Combat Corruption under Prosecutor General of Azerbaijan Zakir Garalov noted that, experiences of specialized anti-corruption organizations of leading European countries, implementing within the EU Twinning project have been learned: “I’d like to stress that, the measures on anti-corruption spheres taken by Azerbaijan’s political leadership yields results. These works are being appreciated by international communityâ€.
