Latif Huseynov: “It must be a duty of judges to implement international convention”

But judges mostly don’t appreciate the usefulness of this convention. Azerbaijani judges as judges of other countries prefer the implementation of domestic laws. This is an ordinary process and I consider it normally. Bu in some cases there is a need to implement international convention as well. It must be a duty of judges to implement it”, the chairman of the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment, head of department of the Azerbaijani Parliament Latif Huseynov said at the session of the Summer School for Judges and Lawyers.

L. Huseynov said that sometimes domestic laws contradict to international convention: “That’s why the implementation of international convention turns into duty for judges. I don’t say that if the judges use only European convention, they can violate international law or vice versa”.

L. Huseynov spoke about the state’s role in the protection of human rights: “The human rights are protected not only from the state, but by the state as well. Germany’s law has such convention dealing with the human rights. But classic human rights describe it as the protection of this issue from the state.”
