Social support mechanisms for internally displaced persons (IDPs) are being gradually transitioned to a new model, APA reports.
This is reflected in the amendments to the Law "On the Social Protection of Internally Displaced Persons and Persons Equal to Them," approved by President Ilham Aliyev.
It was noted that, until now, the social protection measures provided for under the law remained in force for three years from the time conditions were created for IDPs to return to their former places of residence. For persons equated with IDPs, these measures remained in force until conditions were created for their return to their previous places of residence or until they permanently settled elsewhere.
According to the amended law, the social protection measures stipulated by the law will remain in force for three years from the date an internally displaced person loses their IDP status.
Previously, IDPs were allowed to arrange temporary accommodation independently, provided this did not violate the rights and legitimate interests of others. In such cases, the relevant executive authorities were required to relocate them to another residential property within the same settlement.
Under the amendments, the requirement that the alternative housing be located within the same settlement has been removed. In other words, in such cases, the relevant executive authorities must simply offer the IDPs another residential property.
According to the transitional provisions, for IDPs who, before the law entered into force, had been provided free of charge with another residence in the liberated territories instead of their former homes, the period during which they are entitled to the social protection measures provided by the Law "On the Social Protection of Internally Displaced Persons and Persons Equal to Them" will be calculated from the date they were provided with such housing.
At the same time, the law stipulates that, for IDPs who, before the law entered into force, were studying on a tuition-paying basis at state higher and secondary specialized educational institutions and whose tuition fees were covered by the state budget, those tuition fees will continue to be paid from the state budget until they complete their education.
