European court passes preliminary decision on Hilal Mammadov’s case

Baku. Malahat Najafova – APA. The Chamber of the European Court of Human Rights passed a preliminary decision on the case of Hilal Mammadov, the editor-in-chief of Azerbaijani-based newspaper “Talishi Sado”, who was jailed for 5 years on 27 Sept. 2013 after being charged under a number of articles of Azerbaijan’s Criminal Code.

 

Relying on Article 3 of the European Convention on Human Rights and the fact that the license of Mammadov’s lawyer to practice law had been suspended and it had been impossible to meet with him in prison, the European court passed a decision on the violation of Article 34 and payment of compensation of 13,000 euros (EUR) (non-pecuniary damage) and EUR 2,500 (costs and expenses).

 

Hilal Mammadov is charged under articles #274 (treason), 283 (excitation of national, racial or religious hostility) and 234 (illegal manufacturing, purchase, storage, transportation, transfer or selling of narcotics, psychotropic substances) of the Criminal Code of Azerbaijan.
