European Court’s judgment on Ali Insanov considered at Plenary Meeting of Supreme Court

Baku. Shahriyar Alizadeh – APA. The judgment of the European Court of Human Rights (ECHR) on the former Azerbaijani Minister of Health Care Ali Insanov has been considered at the Plenary Meeting of Supreme Court today, APA reports.

Ali Insanov’s lawyer Toghrul Babayev told journalists that according to the decision passed at the Pleanry Meeting the judgments of Court of Appeal and Supreme Court on Ali Insanov were abolished.

The judgment passed by the court of first instance remained unchanged and Ali Insanov wasn’t released. The case was sent to Baku Court of Appeal for reinvestigation.

Toghrul Babayev said they will appeal to the Committee of Ministers of the Council of Europe against the decision of the Plenary Meeting.

On March 14, 2013, the European Court of Human Rights announced its judgment on the appeal of Ali Insanov, the former health minister of Azerbaijan.

According to the judgment, Ali Insanov’s appeals on article 3 (prohibition of torture and of inhuman or degrading treatment), Article 6 § 1 and 3 (right to a fair trial) of the European Convention on Human Rights were ensured.

Under the judgment, the Azerbaijani government is to pay € 10 000 compensation to Ali Insanov.

Insanov detained in October, 2005 was convicted of a number of serious criminal offences, including embezzlement of public funds and arranging for unlawful privatization of State-owned property assets, and sentenced in April 2007 to 11 years’ imprisonment, with confiscation of property and a three-year ban on holding public office.
