Attorney Jeyhun Yusifov told APA that during the hearing the court partially satisfied their claims, reaching the decision that Bayram must be compensated AZN 3,000.
Attorney Jeyhun Yusifov said the court verdict was unfair and that they would file an appeal.
“Bayram Niyazov was charged under Article 234.4.3 (Manufacturing, purchase, storage, transfer, transportation or selling drug with a view of illegal manufacturing and processing of narcotics or psychotropic substances). Mentally ill Bayram Niyazov had allegedly sold narcotics. However, the Ganja Court on Grave Crimes proved him innocent and he was acquitted. We then demanded public compensation for his illegal imprisonment. The statement of claim had demanded AZN 62,200 compensation,” he said.
Bayram Niyazov was arrested in Ganja in 2012. According to the accusation, he gathered cannabis plants from a neglected area in the Saribulag village of Balakan district and brought them to Ganja district on the day of his detention. He was arrested while selling over 2kg drug substance to a conditional buyer, Vugar Gadirov, chief operating officer of Criminal Investigation Department of Linear Police Department in Ganja, for $ 3000.
During the hearing held at the Ganja Court on Grave Crimes, the court found out that Niyazov has been ill since his childhood and was arrested based on slander.
The court issued a verdict of acquittal for Niyazov and he was released from the courtroom.
The judges came to the conclusion that Elshad Mesiyev, who took part in the arrest of Niyazov, is the instigator of the police. Therefore, they passed a decision on Elshad Mesiyev and the operators involved in the operation.
