Baku. Shahriyar Alizade – APA. The Baku Court of Grave Crimes on Wednesday resumed the trial of Taleh Baghirov, Fuad Gahramanli and others.

 

Witness Jeyhun Imamverdiyev, representing the Main Directorate for Combating Organize Crime, answered questions, saying the detainees were not tortured during and after detention.

 

The witness said Etibar Ismayilov wielded a dagger and a grenade. The latter rejected the claim.

 

Upon this, Taleh Baghirov intervened, saying “People’s lives are being dealt with here. How come you even saw white hairs on the head of a running man?

 

Defendant Shamil Abdulaliyev’s attorney made a petition for the sentence of his defendant to be commuted to house arrest, and attorney Nemat Karimli suggested that witness Elchin Taghiyev should undergo psychiatric examination. The public prosecutor asked for a denial of the petitions, saying Taghiyev testified enough. As for the petition concerning Shamil Abdulaliyev, the prosecutor said an expertise has been created for him and that the petition can only be satisfied if the expertise give an opinion.

 

The court paused for consultation, and came back to announce that the petitions had all been denied.

 

Later on, Shahlar Jafarov from the Main Directorate for Combating Organized Crime testified, saying Taleh’s house was raided based on information they had received. According to him, despite warnings, those inside the house did not surrender and then a gunfight erupted. He neutralized Jabbar Jabbarov with his gun.

 

Shahlar Jafarov, who is recognized as an aggrieved party, mentioned in his testimony during the preliminary investigation that after being sure of presence of Baghirov together with his supporters in the house, located on the right side of the entrance to the courtyard, he and other members of the Task Force entered the yard. At this time, those who were in the house and the yard began to fire at them. Despite repeated warnings, they continued firing at the police using submachine guns and pistols. When he tried to grab the gunman in the yard, the man began to resist him. Therefore, that person was neutralized by using physical force against him. He took his pistol and saw that the clip was empty. After the shooting is over, witnesses were called to the scene and the person was identified as Jabbarov Jabbar Amirkhan. Jabbarov said that the pistol belonged to him, he had it to use against the police on the order of Taleh Baghirov.

 

Answering questions of the lawyers, Jafarov said that he didn’t torture anyone. However, the accused persons claimed that Jafarov was one of the persons who tortured them. The witness refuted it and said that he didn’t torture anyone.

 

The process will be resumed on September 7.

 

Taleh Bagirov is charged under paragraphs 120.2.1, 120.2.3, 120.2.4, 120.2.7, 120.2.12 of article 120 (premeditated murder), 29,120.2.1, 29,120.2.3, 29,120.2.4, 29,120.2.7, 29,120.2.12 29,120 of article 29,120(attempt to murder), under articles 228.3 (illegal purchase of firearms) and 228.4 (illegal possession of firearms). Taleh Bagirov was detained by law enforcement officials during a special operation in Nardaran settlement of Baku on 26 November. During the operation 60 people were detained. The criminal case of some of them were sent to the Sabunchu District Court.

 

Deputy chairman of Azerbaijan Popular Front Party (APFP) Fuad Gahramanli was arrested on December 8, 2015.

 

He was brought to justice as a suspect under the Article 281.1 (public calls against the state), 283.2 (incitement of national, racial, social or religious enmity and hatred by using violence) and 220.2 (Appeals to active insubordination to legal requirements of representatives of authority and to mass disorders, as well as appeals to violence above citizens) of the Criminal Code of Azerbaijan.
