The appeal filed to the Supreme Court by Haji Mammadov in connection with newly discovered facts of the criminal case is being considered. The appeal will be submitted to the plenum of the Supreme Court after being considered.
“Newly discovered facts” are facts that are unknown to the court when the criminal case is being considered. So, if there is false testimony of a victim or witness, as well as false expert opinion, the accused or prosecutor can appeal to the Supreme Court asking to investigate these circumstances.
The former chief operating officer of the Interior Ministry, Haji Mammadov, and 26 more people were arrested during operation ‘Black Belt’ by Azerbaijan’s Ministry of National Security on March 9-10, 2005.
Mammadov was jailed for life facing charges under 80 articles and his property was confiscated.
Zakir Nasirov, former chief of Interior Ministry's main criminal investigation department, and 8 people were sentenced to life imprisonment.
