Parliament official: Civil servants will not be required to take exams to continue service - EXCLUSIVE

The newly drafted Civil Service Code does not include a requirement for civil servants to take an examination to obtain a subsequent certificate in order to continue their service, Haji Mirhashim Seyid, Head of the Department of State Building, Administrative and Military Legislation of Azerbaijan’s Milli Majlis, told APA.

Seyid said that under the new Civil Service Code, a certificate will be required when entering the civil service, but no certificate will be needed to continue working in the civil service.

“The performance of civil servants will be taken into account through an assessment under the new procedure,” he said.

It should be noted that Article 28-1 of the currently effective Law “On Civil Service” regulates the procedure for continuing service in the civil service.

Under the article, a person wishing to continue working as a civil servant must, during the final year of validity of their certificate and no later than the date on which the certificate expires, participate in examinations conducted by a body established by the relevant executive authority in order to obtain a subsequent certificate and must be certified again.

If a person admitted to the civil service after obtaining a certificate subsequently receives a certificate two more times, the final certificate is issued for an indefinite period, and that person cannot be required to take any further examination in order to continue working as a civil servant.

However, the newly drafted Civil Service Code contains no provision requiring an examination to be taken in order to continue service in the civil service.

A new draft Civil Service Code has been prepared in Azerbaijan.

The draft consists of 15 chapters and 94 articles.

Once the Civil Service Code enters into force, six laws will be repealed: the Law “On Civil Service,” the Law “On Reduced Working Hours for Certain Categories of Civil Servants,” the law approving the Regulations “On the Civil Service Management Council of the Republic of Azerbaijan,” the Law “On Determining Local Coefficients for the Official Salaries of Civil Servants,” the Law “On Determining Increased Coefficients for the Official Salaries of Civil Servants in State Bodies Where Service Conditions Are Dangerous to Life and Health or Particularly Difficult,” and the Law “On Rules of Ethical Conduct of Civil Servants.” The draft legislation submitted to parliament confirms that the existing laws listed in the bill are to be repealed once the new Code takes effect.

The draft Civil Service Code was adopted in the first reading at the plenary session of the Milli Majlis held on September 30.
