Azerbaijan to mandate equal pay for work of equal value regardless of gender

The obligation of employers to ensure equal pay is being specified in order to guarantee gender equality, APA reports.

This is reflected in the proposed amendment to the Labor Code discussed at today’s meeting of the Milli Majlis Committee on Labor and Social Policy.

Under the draft, employers are required to pay equal wages to employees performing the same or different work of equal value, regardless of gender. The determination of work of equal value must be made by the employer, taking into account working conditions, the nature of the labor function, and the tariff-qualification characteristics set out in the unified tariff-qualification reference books currently in force.

Accordingly, under the proposed amendment to the Law “On Guarantees of Gender (Equality of Men and Women),” wages are envisaged to be paid not only for the same or similar work, but also for work of equal value.

Under Article 9.1 of the law, “employees working in the same workplace, possessing the same qualification level, working under the same conditions, and performing work of equal value, regardless of gender, must be paid equally, including wages, bonuses, and other financial incentives.”

Under the mentioned article, equal pay is provided to men and women who perform the same work with the same qualification level and value.

This concept is narrower than the standard of equal pay for work of equal value, as it does not apply to men and women performing different jobs of equal value.

In this regard, Article 9.1 is proposed to be presented in a new wording.
